Can the Board hire a property management company to manage the sub without a vote from the Owners?
Yes, per Article III sections 3.3 of the Bylaws: 3.3 Powers and Duties. The Board of Directors shall have the powers and duties necessary for the administration of the affairs of the Association and may do all acts and things as are not prohibited by the Declaration of Covenants and Restrictions Documents or required thereby to be exercised and done by the Owners.
Can there be more than one Homeowner on the Board from the same household?
Yes, however, per Article II, Section 2. Voting Rights of the Declaration of Covenants and Restrictions, there is only one vote per household.
Are sheds or other storage units, tents, trailers, commercial vehicles, RVs allowed on a homeowner’s property?
No, these items are not permitted either temporary or permanently. Please see Article VI, Section 11, Temporary Structures, of the Declaration of Covenants and Restrictions (C&Rs), for the very limited exceptions.
How many dogs or cats may I keep on my property?
Only two (2) animals. See Article VI, Section 10, Animals, of the Declaration of Covenants and Restrictions (C&Rs).
Are carports or other structures allowed on the property?
No, please review Article VI, Section 1, Permitted Use, of the Declaration of Covenants and Restrictions (C&Rs).
Can I use my home as a business?
No, please review Article VI, Section 1, Permitted Use, of the Declaration of Covenants and Restrictions (C&Rs).
Are fences allowed?
No, please review Article VI, Section 8, Walls and Fences, of the Declaration of Covenants and Restrictions (C&Rs), except for wrought iron fencing used to enclose a permitted swimming pool.
Are swimming pools allowed?
No above ground pools are allowed. In-ground pools must be approved by the Board. Please review Article VI, Section 9, Swimming Pools, of the Declaration of Covenants and Restrictions (C&Rs).
Are vehicles allowed to be stored on the property?
No house trailer, commercial vehicle, truck, boat, camper, RV, etc. can be stored or parked on property. See Article VI, Section 12, Storage of Vehicles, of the Declaration of Covenants and Restrictions (C&Rs).
Are vehicles allowed to park on any circular driveway?
No, a circular driveway is for architectural purposes only and not for parking.
Are antennas allowed on the home?
No. See Article VI, Section 13, Antennas, of the Declaration of Covenants and Restrictions (C&Rs) for additional information.
Can I hang clothes to dry outside?
No. See Article VI, Section 14, Unsightly Conditions, of the Declaration of Covenants and Restrictions (C&Rs).
Are window ACs allowed on the home?
No external air condition unit shall be placed in or attached to a window or wall of a home. See Article VI, Section 19, Air Conditioners, of the Declaration of Covenants and Restrictions (C&Rs).
If a tree falls on a homeowner’s property, who is responsible for removing and replacing the tree?
If it is on a homeowner’s property and NOT in the common area, it is the homeowner’s responsibility to remove and replace the tree9s).
Can a homeowner be fined for not maintaining his/her property? And how much?
Yes. Please review the Schedule of Fines under the “Documents for Homeowners” under the “Key Info” tab on our website RiverWoodsofCanton.org.
When I have to replace a tree, what type of tree do I replace it with and are there specifications?
Please see, the Proper Tree Selection linked here for more information on the tree type. Please ask a Board member regarding the dimension of the newly planted tree.
Are Board members compensated for the work they do?
No. Per Article II 3.1 of the Bylaws, Directors shall serve without compensation.
Who enforces the provisions of the Declaration of Covenants and Restrictions?
The Board, per Article III Section 3.4 J of the Bylaws.
Do homeowners need permission to make changes to their property and landscaping?
Yes. All plans must be submitted to the Board for review and prior approval before work can begin. Please review Article V, Section 1, Architectural Review Committee, and Section 3, Final Approval, for more information.
What happens if I don’t pay my dues?
Late dues will be assessed interest, a lien can be placed on the property, your property foreclosed on, and you can be responsible for attorney fees. See First Amendment to Declaration of Covenants and Restrictions (C&Rs), Article IV, Section 10, Effect of Non-Payment of Assessment.
What are my dues used for?
Per Article IV, Section 3, Purpose of Assessments, of the Declaration of Covenants and Restrictions (C&Rs), the dues are for maintenance of the Common Areas, enforcing the C&Rs, and providing other community services desired by the homeowners (e.g. fixing curbs and gutters).
Can my HOA dues be increased without a vote from the homeowners?
Yes. Per Article IV, Section 4(c) of the Declaration of Covenants and Restrictions (C&Rs), so long as the assessment is not more than 10% above the maximum assessment for the prior year, no vote is needed and no notice has to be given.
Can homeowners volunteer to help the Board?
Yes, the Board welcomes all volunteers. Volunteers will help the Board with our tasks
and avoid the need to hire a property management company to handle some
responsibilities.
How often will HOA meetings be held?
Meetings will be held every quarter.
